Ces conditions expliquent les principales règles d’utilisation de NinjaAssurance, notamment la disponibilité de l’application, les limites des destinations SMS, les achats, tout essai gratuit de 14 jours proposé aux nouveaux utilisateurs éligibles, le consentement des contacts de confiance, les services tiers, les limites du service et le fait que NinjaAssurance n’est pas un service d’urgence. Les traductions sont fournies par commodité. Si une version traduite diffère du texte juridique anglais, la version anglaise prévaut.

Achats et essai

Basic et Premium sont des achats uniques sauf indication contraire dans la fiche du store. Lorsqu’un essai est proposé, il est limité aux nouveaux utilisateurs éligibles une fois par utilisateur et par appareil.

Pas de surveillance d’urgence

L’application prend uniquement en charge des check-ins de sécurité et ne doit pas être utilisée comme système d’urgence, médical, de secours ou de réponse garantie.

Les SMS aux contacts de confiance ne peuvent être tentés que vers les pays/destinations indiqués sur ce site et uniquement vers des contacts ayant accepté de recevoir des alertes. La livraison n’est pas garantie.

Aperçu du service

NinjaAssurance fournit des check-ins de sécurité programmés et une escalade SMS optionnelle aux contacts de confiance si l’utilisateur ne confirme pas. Le service est un outil de communication de confort et de tranquillité, pas une surveillance d’urgence.

Disponibilité de l’application

NinjaAssurance est disponible pour les utilisateurs de l’application en Europe, au Canada et aux États-Unis, sauf indication contraire dans la fiche du store ou dans l’application. La disponibilité peut varier selon le store, l’appareil, le système d’exploitation, le statut du compte, la loi, le prestataire de paiement et la disponibilité technique.

Les SMS aux contacts de confiance ne peuvent être tentés que vers les pays indiqués sur le site, selon les paramètres du fournisseur SMS de NinjaAssurance vérifiés le 11 juin 2026. La liste ne garantit pas la livraison et peut changer sans préavis. Contacts de confiance et consentement

Les utilisateurs sont responsables du choix attentif des contacts, de l’entrée de numéros exacts au format international, de l’obtention de l’autorisation de chaque contact avant d’activer les SMS et de la suppression des contacts qui retirent leur consentement ou ne doivent plus recevoir d’alertes.

Services tiers et utilisation des données

L’application peut utiliser des prestataires tiers tels que Twilio pour les SMS, Google Firebase pour l’infrastructure, Google Analytics / services Google pour l’analyse et le diagnostic, les stores/prestataires de paiement pour les achats, et les prestataires d’hébergement/sécurité. Ces prestataires peuvent traiter les données nécessaires au fonctionnement, à la protection, au support, à l’analyse et à l’amélioration. NinjaAssurance ne vend ni ne loue les données personnelles.

Achats et essai gratuit de 14 jours

Basic et Premium sont présentés comme des achats uniques sauf indication contraire dans la fiche du store. Si un essai gratuit de 14 jours est proposé, il est réservé aux nouveaux utilisateurs éligibles et peut être limité à une fois par utilisateur et par appareil. L’accès d’essai peut être bloqué, refusé, annulé ou indisponible en cas d’utilisation antérieure ou d’abus.

Aucune garantie d’urgence

NinjaAssurance n’est pas un service d’urgence, de secours, de sauvetage, médical, de sécurité ou de surveillance garantie. Les alertes, notifications et SMS peuvent échouer, être retardés, filtrés, bloqués, indisponibles dans certains pays ou réseaux, ou ne pas être remarqués. En cas d’urgence, les utilisateurs doivent appeler directement les services d’urgence locaux.

Responsabilités de l’utilisateur

Les utilisateurs doivent utiliser l’application légalement, conserver des informations exactes, maintenir les autorisations et la connexion, vérifier les paramètres après changements d’appareil ou de fuseau horaire, surveiller les restrictions batterie/système et tester régulièrement si les check-ins et alertes répondent à leurs besoins.

Disponibilité et modifications

Le service peut être mis à jour, amélioré, restreint, suspendu, arrêté ou rendu indisponible. Les fonctionnalités, destinations, essais, limites SMS, prix et prise en charge des prestataires peuvent changer. Une disponibilité continue ou sans erreur n’est pas garantie.

Limitation de responsabilité

Dans la mesure maximale permise par la loi, NinjaAssurance est fourni sans garantie de fonctionnement parfait, et la responsabilité pour pertes indirectes, consécutives, liées au service, au réseau, aux prestataires, aux alertes manquées, retardées ou messages non livrés est limitée ou exclue.

Droit applicable et contact

NinjaAssurance: Terms of Use & Disclaimer

IMPORTANT — ENGLISH VERSION CONTROLS
These Terms of Use are provided in English as the controlling legal version. The website may provide translated summaries or translated detail sections for convenience. If any translation conflicts with this English text, the English text controls to the maximum extent permitted by law. If you are unsure about any term, do not use the App.

1. Acceptance of Terms
By downloading, installing, accessing, or using NinjaAssurance (“the App”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use the App and should uninstall it immediately.

2. Changes to Terms and Privacy Policy
We may update these Terms and/or the Privacy Policy from time to time. The “Last updated” date above shows when the latest changes took effect. We will use reasonable efforts to notify users of material changes in-app, on the website, and/or by email where appropriate. You are responsible for reviewing these Terms and the Privacy Policy periodically. Continued use after an update means acceptance. If you do not accept changes, you must stop using the App and withdraw consent via the Settings menu or by contacting support@ninjaassurance.com.

3. Eligibility
You must be at least 18 years old, or the minimum legal age required in your jurisdiction, whichever is higher, to use NinjaAssurance. By using the App, you confirm that you meet this requirement.

4. Service Description & Intended Use — Not an Emergency Service
NinjaAssurance provides scheduled safety check-in reminders. If a user fails to check in, alerts through push notifications, local notifications, and/or SMS may be sent to the user and/or nominated trusted contacts depending on the user’s configuration, plan, permissions, provider support, and service availability.

NinjaAssurance is not an emergency, rescue, life-saving, medical, security, or guaranteed monitoring service. It does not contact official emergency services. It is not a substitute for calling local emergency services, local authorities, medical providers, family, carers, workplace safety systems, or any other professional or emergency support. Users and contacts must not rely on NinjaAssurance as the only or primary way to ensure personal safety.

5. App Availability
NinjaAssurance is available for app users in Europe, Canada, and the United States unless the applicable app store listing or in-app information states otherwise. Availability may vary by store, device, operating system, account status, payment provider, legal restrictions, language, country, and technical service availability. The App or any feature may be unavailable, restricted, or changed in some locations.

6. Automated Operation — No Human Monitoring
Check-in reminders, escalation logic, and alert delivery are automated. NinjaAssurance staff do not monitor, review, or intervene in individual user cases, check-ins, alert events, or SMS delivery events.

7. No Guarantee of Delivery, Timing, Availability, or Results
The App depends on third-party services and infrastructure, including device settings, operating system permissions, internet connectivity, mobile networks, push notification services, app stores, cloud services, Firebase, analytics/diagnostics services, SMS providers such as Twilio, carrier filtering, and recipient devices. Delivery of notifications or SMS alerts cannot be guaranteed, and delays, failures, blocking, filtering, duplicate messages, language fallback, or non-delivery may occur.

Service limitations, including country, carrier, provider, legal, fraud-prevention, fair-use, account, or technical restrictions, may prevent SMS delivery. A listed SMS destination does not mean delivery is guaranteed.

8. SMS Destination Availability and Country Restrictions
Trusted-contact SMS can be attempted only to countries listed on the website, based on NinjaAssurance’s SMS provider settings reviewed on 11 June 2026. The public list is intended to show where SMS may be attempted for trusted-contact alerts; it is not a guarantee that any SMS will be delivered.

The list may change without notice. SMS delivery may fail, be delayed, filtered, blocked, unavailable, or restricted because of provider rules, carrier networks, local law, consent requirements, user/device settings, account limits, fraud prevention, fair-use controls, or technical problems.

If a country is not listed, or if SMS delivery to a specific country is important for your use case, contact support@ninjaassurance.com before relying on it. NinjaAssurance does not guarantee that any country will remain valid, supported, reachable, or deliverable.

9. User Responsibilities
Accurate Information: You are responsible for providing and maintaining accurate, current, international-format account and contact information.
Contact Consent: By adding trusted contacts, you represent and warrant that you have obtained each contact’s explicit permission to be listed and to receive communications, including SMS where enabled.
Opt-Out and Removal: You must remove any contact who withdraws consent or should no longer receive alerts. Contacts may also contact support@ninjaassurance.com to request reasonable blocking or suppression where technically and legally possible.
Device and Login Security: You are responsible for safeguarding your credentials and device security, using strong and unique passwords, and maintaining sufficient battery, connectivity, notifications, and required permissions.
Single Device Use: Only one active device per account is permitted unless the App states otherwise. Concurrent logins may be blocked.
Configuration and Testing: You are responsible for keeping the App correctly configured and functional, including maintaining internet access, enabling notifications, granting permissions, disabling battery restrictions that may block operation, checking settings after time-zone or daylight saving time changes, and periodically testing check-ins and alerts.

10. Persistent Check-ins and Escalations
Unless you actively remove or cancel scheduled check-ins, alerts and escalations may still occur, even if you log out, delete or uninstall the App, turn off your phone, disable notifications, lose access to your device, change your SIM/number, or stop using the App. It is your responsibility to disable or delete check-ins that are no longer relevant.

11. Acceptable Use
The App may only be used for lawful, respectful, non-harassing, non-fraudulent purposes. You must not misuse the App, attempt to bypass security or trial limits, create fraudulent or abusive alerts, harass others, upload or enter unlawful information, or use the App in a way that violates these Terms, third-party provider rules, carrier rules, or applicable law. We may suspend, restrict, block, or terminate accounts, devices, destinations, alerts, trials, or features for suspected violations or abuse, without refund where permitted by law.

12. Third-Party Services
To provide, secure, analyze, improve, support, and deliver the App, NinjaAssurance may use third-party services for hosting, app infrastructure, crash reporting, diagnostics, analytics, app store/payment handling, push notifications, messaging, and SMS delivery. Examples may include, without limitation:
• Google Firebase
• Google Analytics / Google services
• App store and payment providers
• Hosting, cloud, security, logging, and support providers
• Twilio or other SMS/messaging providers

These third parties may process data as described in the Privacy Policy and under their own terms and privacy policies. NinjaAssurance is not responsible for third-party services, networks, outages, policies, carrier filtering, provider restrictions, or provider changes.

13. Data Privacy, No Sale, Retention, and Compliance Summary
Your use of the App is also governed by our Privacy Policy. The App may process account data, phone numbers, trusted-contact information, check-in settings, purchase/access status, support messages, diagnostics, analytics events, delivery logs, and technical data needed to operate and protect the service.

NinjaAssurance does not sell or rent personal information. Trusted contacts’ data is used for safety notifications and service operation, not for marketing by NinjaAssurance. Data may be shared with service providers only for operating, protecting, supporting, analyzing, improving, enforcing, and delivering the App, handling purchases, complying with law, resolving disputes, preventing abuse, or delivering messages requested by the user.

Operational data is kept only as long as needed for the service, law, disputes, security, fraud prevention, enforcement, and support. Security/SMS/provider logs may be retained where needed for operational, legal, billing, abuse-prevention, or compliance reasons. Account deletion or consent withdrawal requests are handled as described in the Privacy Policy, subject to legal, technical, security, billing, dispute, and abuse-prevention exceptions.

14. Notifications, Language, and Limitations
SMS alerts are sent in the user-selected app language where supported. Language fallback may occur if a language is unavailable, if provider limitations apply, or if technical restrictions require it. SMS language does not automatically change based on a contact’s country code or phone number. Notifications and alerts may still be attempted even if the user’s device is off or disconnected at the time a check-in is missed, but delivery and timing are not guaranteed.

15. Payments, Trials & SMS Limits
If the App includes paid plans, one-time purchases, trials, or SMS usage limits, those details are shown in-app and/or in the relevant store listing. Basic and Premium may be offered as one-time purchases unless the applicable app store listing states otherwise. App store, payment provider, tax, currency, and refund rules may also apply.

14-Day Free Trial: Where NinjaAssurance offers a free trial, the trial lasts 14 days and is available only to eligible new users. Unless we state otherwise in-app or in the relevant store listing, the free trial may be used once per user and once per device.

Trial Blocking and Eligibility: If a user, account, device, payment/store profile, phone number, provider signal, fraud-prevention signal, or other reasonable eligibility signal shows that a free trial has already been used, the free trial may be blocked, refused, cancelled, or unavailable. This includes situations where a trial has previously been used on the same device, even if a different account is later used on that device. Attempts to bypass trial limits, including device resets, multiple accounts, false information, fraudulent activity, or other abuse, may result in blocked trial access, account/device restrictions, suspension, or termination.

No Trial Guarantees: A free trial is provided “as is” and “as available.” A trial does not guarantee uninterrupted access, future feature availability, SMS delivery, alert delivery, support response times, refunds, compensation, or that the App will meet any particular purpose. Trials have no cash value, cannot be transferred or exchanged, and may be changed, withdrawn, or discontinued where permitted by law.

SMS Limits: SMS use may be limited, including a current fair-use limit of 18 SMS per year per user unless stated otherwise in-app or in the relevant store listing. Abuse, invalid destinations, provider restrictions, unusual sending patterns, fraud-prevention concerns, or legal concerns may result in blocking, throttling, or suspension.

16. Ads & Tracking
The App may display third-party ads or use analytics/diagnostics. Tracking, personalized ads, measurement, and analytics may depend on OS-level consent settings, app settings, provider settings, and applicable law. You should not send sensitive or unnecessary personal information through support messages, analytics fields, or other free-text fields.

17. Beta Features
Beta, preview, or experimental features may be unstable and may change, be restricted, removed, or become paid features at any time.

18. Accessibility
We aim to provide basic accessibility features, but the App may not meet all accessibility requirements in all jurisdictions or for all user needs.

19. Intellectual Property
All code, design, layouts, trademarks, branding, text, graphics, and other content belong to NinjaAssurance or its licensors. You may not copy, modify, distribute, resell, sublicense, scrape, or reverse engineer the App except where expressly permitted by law.

20. Disclaimer and Limitation of Liability
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND TO THE MAXIMUM EXTENT PERMITTED BY LAW.

NinjaAssurance is not an emergency, rescue, life-saving, medical, security, or guaranteed monitoring service. To the maximum extent permitted by law, NinjaAssurance is not liable for direct, indirect, incidental, special, consequential, exemplary, service-failure-related, network-related, provider-related, missed-alert, delayed-alert, undelivered-message, data-loss, loss-of-profit, personal injury, emotional distress, or reliance damages arising from or related to use of the App, inability to use the App, third-party services, network failures, device issues, provider restrictions, SMS failures, notification failures, or user configuration.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.

21. Indemnification
You agree to indemnify and hold harmless NinjaAssurance from claims, losses, liabilities, costs, and expenses arising out of your misuse of the App, violation of these Terms, violation of law, inaccurate information, lack of contact consent, harassment, or violation of third-party rights, to the extent permitted by law.

22. Service Changes, Suspension, and Discontinuation
We may modify, update, restrict, suspend, or discontinue the App, any feature, trial, destination, plan, SMS sending, provider integration, or access at any time, with or without notice, where permitted by law. NinjaAssurance is not liable for modification, suspension, discontinuation, provider changes, or unavailable features.

23. Abuse & Enforcement
We may investigate suspected abuse and take action, including warnings, account restriction, account termination, device blocking, alert blocking, destination blocking, trial blocking, support restrictions, or feature restrictions, without refund where permitted by law.

24. Support Conduct
Respectful communication is required. Abusive, threatening, harassing, unlawful, or spam-like messages may result in restricted support access.

25. App Store Terms
Where you downloaded the App from an app store, that store’s terms, payment rules, refund rules, tax rules, and platform requirements may apply and may control certain purchase or refund handling.

26. Governing Law
Estonian law applies, unless mandatory consumer protection laws in your jurisdiction require otherwise.

28. Miscellaneous
These Terms constitute the entire agreement regarding the App and supersede prior versions. If any part is found unenforceable, the remaining parts remain in effect to the maximum extent permitted by law.

This appendix is based on the SMS geographic permission settings selected in the NinjaAssurance Twilio account and reviewed by the account owner on 11 June 2026. It is not a delivery guarantee and may change without notice. SMS may be attempted only to the countries/destinations listed below for trusted-contact alerts. Countries/destinations not listed should be treated as not currently represented as available for trusted-contact SMS on the website.
